A recent article in the TALON states that “Because of Kaepernick’s involvement in Nike, Aztec School District has chosen to forgo buying Nike uniforms for its sports teams this year. The flag is still meaningful to Superintendent Kirk Carpenter and he believes “this is an issue that we need to stand on.”

Numerous internet sites note that West Virginia State Board of Education v. Barnette 319 U.S. 624 (1943) is a landmark decision by the United States Supreme Court holding that the Free Speech Clause of the Constitutional First Amendment protects students from being forced to salute the American Flag or say the Pledge of Allegiance in public school.

The Supreme Court rendered its verdict with the following famous words:

“If there is any fixed star in our constitutional constellation, it is that no official, high or petty can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinions, or force citizens to confess by word or act their faith within.”

This 1943 court decision has been challenged many times, but it still stands. It is now being argued that it may or may not also apply to private business, the NFL players, etc.
